FlixBus White Label Terms and Conditions

1.    Introduction

FlixMobility GmbH, (“FlixBus”) and its global subsidiaries provide Europe’s largest intercity bus network, helping millions of people reach their destinations every day. FlixBus provides the search and booking of this services on a website or in the form of a mobile application, designed to enable end-users (“Customers”) visiting the website.

FlixBus also allows Customers the booking of third-party ground transportation services offered by third party carriers (“White Label Carrier Offers”).  In connection with the White Label Carrier Offers, Customers have the  possibility to book a ground transportation service to a given destination within a selection of third party ground transportation companies authorized by FlixBus to publish and display certain journeys on its web portals (such ground transportation companies, the “Carriers”). FlixBus enables the booking of White Label Carrier Offers via a website at the address booking.FlixBus.com or in the form of a mobile application, designed to enable Customers visiting the website (together the “White Label Platform”).

The applicability of a White Label Carrier Offer will be indicated  by a redirect to the White Labe Platform.

These terms and conditions regulate the access of Customers to the White Label Platform and the terms and conditions of the services provided FlixBus and its partners in relation to the booking of White Label Carrier Offers on the White Label Platform.

2.    Use of the Services

2.1 Ground Transportation Services

In relation to the White Label Carrier Offers published on the White Label Platform, FlixBus does not offer any transport service to the Customers. Carriers are the only party providing and are therefore responsible for the ground transportations service, the ticketing, and conditions and contract of carriage and ticketing.

FlixBus is not a contractual partner in relation to White Label Carrier Offers and the ground transportation services connected to the White Label Carrier Offers and therefore assumes no responsibility for such contract.

Customers acknowledge that ticketing, booking seats for a transportation service and conducting the transportation services is therefore subject to the terms and conditions (“T&C”) of the relevant Carrier which will be accepted upon booking of a White Label Carrier Offer.

FlixBus vouchers (regardless whether in the form of credit vouchers, discount vouchers or InterFlix vouchers) are not redeemable in relation to any White Label Carrier Offers.

2.2 Set Up of the White Label Platform

In order to operate the White Label Platform FlixBus makes use of a third party partner, Distribusion Technologies GmbH, based in Germany (“Distribusion”). Distribusion develops and runs a global distribution system (GDS) for ground transportation tickets, which, includes but is not limited to the supply of ground transportation content, the technical supply of a white label platform solution for customer checkout purposes, payment processing, settlement and invoicing. FlixBus uses the services of Distribusion in a so called “White Label Solution” for the technical supply of the White Label Carrier Offer content and the processing of the White Label Carrier Offer bookings.  

2.3 Information Provided

Customers must ensure to provide truthful, valid and current information while using the White Label Platform. FlixBus and/or its service providers reserve the right to verify, at any time, all or part of the information for the purpose of transparency and fraud detection.

In case Customer wishes to reserve a seat for a minor travelling alone, Customers should be aware of, verify the possibility with, and proceed according to Carrier’s terms and conditions (T&C) accessible in the course of the booking process.

3.    Prices and payments

3.1 Prices and fees

With respect to White Label Carrier Offer ground transportation services, the fee applicable to the ground transportation conditions (Price) per passenger is set at the sole discretion of the Carrier or its partner.

3.2 Payment

In addition to FlixBus’ use if its services under 2.1, Distribution will also serve as Carrier’s cooperation partner. If you have any complaints or questions regarding the payment of a White Label Carrier Offer, please contact FlixBus Customer Service. We will forward your complaint or question to Distribusion.

When purchasing a bus ticket on the White Label Platform, Customers will pay the amount of the ticket to the issuer of the ticket from whom Customers bought the ticket; and if applicable, a service fee in addition to the ticket price (“Service Fee”).  The Service Fee (if applicable) will be displayed to the Customer before booking a ticket.

If you wish to cancel a White Label Carrier Offer that you have already booked, please refer to the rules for cancellation below under 4.

3.3 Payment Methods

White Label Carrier Offers on the White Label Platform are payable by the following payment methods:

•    Credit Cards (Mastercard/Visa)
•    Google Pay

If payment is made by credit card or Google Pay, the Customer account will be charged upon completion of the booking. The cardholder’s name and credit card details will be forwarded by Distribusion to its payment service provider, Adyen, Adyen N.V. Simon Carmiggeltstraat 6-50, 1011 DJ The Netherlands.

4.    Cancellation Policy

In case of cancellation of the booked transportation service by the Carrier Customer has in accordance with applicable law and/or Carriers T&C the right to demand from the Carrier the reimbursement of the amount paid and or other rights against the Carrier under such law. Details are laid out in Carrier’s T&C’s. In relation to White Label Carrier Offers FlixBus is not responsible and shall not be held accountable for the reimbursement of any amount, or for any damages or loss of profits or for the organization of alternative or replacement transportation services.
 
When cancellation occurs on the side of the Customer, cancellation rights are subject to the terms and conditions (T&C) of the relevant Carrier which will be provided upon booking. Nevertheless, the Service Fee (if any) may be kept by FlixBus.  

For Carriers that allow cancellation and / or rescheduling of the tickets online, these operations are only available according to Carrier’s T&C. To the extent online cancellation is possible according to Carrier’s T&C, cancellation can be conducted via the link provided in the booking confirmation in respect to the White Label Carrier Offer.

5.    Personal data

In the context of Customers’ use of the White Label Platform, FlixBus and/or Distribusion might collect and process some of the personal data provided by the Customers. In using the Platform Customers recognize and accept the processing of their personal data by FlixBus as well as Distribusion in compliance with the applicable law and the stipulations of the White Label Platform Privacy Policy.

6.    Use of the White Label Platform

FlixBus grants Customers a non-exclusive, personal and non-transferable right to use the White Label Platform and the services, for Customers’ personal and private use, on a non-commercial basis and in compliance with the purposes of the White Label Platform and the services.

Customers are prohibited from any other use or exploitation of the White Label Platform and services, and their content, without the prior written permission of FlixBus. In particular, Customers are prohibited from:
-    using the White Label Platform for any commercial, or profit orientated use;
-    reproducing, modifying, adapting, distributing, publicly representing and disseminating the White Label Platform, the services and the content, other than expressly authorized by FlixBus in writing;
-    decompiling and reverse engineering the White Label Platform or the services; or
-    extracting or attempting to extract (for example by using data mining robots or any other similar data collection tool and/or performing “screen scraping) the data of the White Label Platform.

7.    Role of FlixBus

The Platform constitutes an online platform on which Customers can directly book a ground transportation service provided by a specific Carrier listed on the White Label Platform. Thereby the White Label Platform enables the conclusion of transactions for ground transportation services between the Customer and the Carrier, but FlixBus is not a contractual partner in relation to any White Label Carrier Offer and/or the ground transportation services connected to the White Label Carrier Offers. In using the White Label Platform and in accepting these general terms and conditions, Customers recognize that FlixBus is not party to any agreement entered into between Customers and Carriers.

FlixBus does not provide any transport service and does not act in the capacity of a Carrier; the role of FlixBus is limited to facilitating access to the White Label Platform therefore as an intermediary, cannot be held liable for the effective occurrence of a ground transportation service, and is in particular not responsible for:

  • erroneous information communicated by the Carrier regarding the ground transportation service;
  • cancellation or modification of a service by either a Customer or a Carrier;
  • non-payment of Service Fee by a Customer;
  • the behavior of Customers during, before or after the service is provided.

FlixBus has no control over the behavior of Customers and Carriers on the White Label Platform. It does not own, exploit, supply or manage and therefore shall not be responsible the conditions of the vehicles performing the booked ground transportation service.

The listing of a Carrier on the White Label Platform or on any other FlixBus websites does not and should not constitute a recommendation or endorsement of the quality, level of service, qualification, or type of transport services of a Carrier (or its facilities, venues, vehicles, (main or ancillary) products or services) are not to be regarded as such, unless explicitly stated otherwise.

FlixBus assumes no liability or responsibility for any communication from or with the Carrier on or through the White Label Platform. You cannot claim any rights against FlixBus from requests to, from communications with the Carrier or any acknowledgements from the Carrier in relation to the receipt of a communication or of a request from the Customer. FlixBus cannot guarantee that requests or communications to or from the Carrier will be read, answered, received, fulfilled, executed or accepted (in a timely manner).

8.    Operation, availability and functionalities of the Platform

FlixBus and its service providers tries to maintain the White Label Platform accessible at all times. Nevertheless, access may be temporarily suspended without notice, owing to technical maintenance, migration or update operations or any other technical difficulties in relation to the White Label Platform, the internet access or the internet in general.

FlixBus reserves the right to modify or suspend, temporarily or permanently, in whole or in part, individually or in general the access to the White Label Platform or its features.

9.    Applicable law and jurisdiction

These T&Cs are written in English and subject to German law.

The place of jurisdiction for registered traders and legal entities as well as for natural persons whose domicile or habitual residence at the time of the relevant legal action is not known, is Munich.
